Terms of Use

These Terms govern your use of GlizzyScan, provided by XYK LLC (“XYK,” “we,” “us,” or “our”). By downloading, accessing, or using GlizzyScan, you agree to these Terms.

1. Apple license terms

Your license to the iOS app is also subject to Apple’s Standard End User License Agreement (“Apple EULA”), which is incorporated into these Terms. These Terms supplement the Apple EULA. If a provision conflicts, the Apple EULA controls with respect to your license from Apple, and these Terms control the GlizzyScan service to the extent permitted by law.

2. Eligibility and accounts

GlizzyScan is intended only for adults age 18 or older. You must be legally able to enter into this agreement. A private guest account may be created automatically to authenticate requests and subscriptions. You may optionally link Apple or Google sign-in. You are responsible for safeguarding access to your device and linked accounts and for activity performed through them.

3. Nutrition estimates and your responsibility

AI-generated and database nutrition results can be incomplete, inaccurate, or inappropriate for your circumstances. Serving sizes, ingredients, preparation methods, restaurant recipes, and image interpretation can materially change an estimate. Review and edit results before relying on or saving them.

Do not use GlizzyScan as a substitute for a physician, registered dietitian, or other qualified professional. The app is not designed for emergencies, pregnancy or breastfeeding, eating-disorder care, allergies, or diagnosis or management of diabetes, kidney disease, heart disease, or any other medical condition. If you have symptoms or a health concern, contact a qualified professional; in an emergency, contact local emergency services.

4. Subscriptions, trials, and billing

Manual food logging is available without a Pro subscription. GlizzyScan Pro offers monthly and annual auto-renewable subscriptions for AI meal analysis. Prices and billing periods shown in the app at purchase are controlling.

• If Apple determines that your Apple Account is eligible for an introductory offer, a seven-day free trial converts to the selected paid plan unless canceled before the trial ends.
• Payment is charged to your Apple Account when you confirm purchase. The subscription renews automatically unless canceled at least 24 hours before the end of the current trial or billing period.
• Apple may charge the renewal within 24 hours before the current period ends. You can manage or cancel in Apple Account subscription settings.
• Deleting a GlizzyScan account or the app does not cancel an Apple subscription. Apple processes billing, cancellations, refunds, and applicable price-change notices under its terms.

5. Your content and privacy

You retain ownership of meal descriptions, photos, diary entries, and other content you provide. You give XYK a limited, non-exclusive, worldwide license to host, transmit, process, reproduce, and format that content only as needed to provide, secure, troubleshoot, and improve the requested GlizzyScan service. This license ends when the content is no longer needed for those purposes, subject to backups, legal retention, and third-party processing described in our policies.

Our Privacy Policy explains our personal-data practices. Our Consumer Health Data Privacy Policy provides additional disclosures and rights for consumer health data. GlizzyScan does not sell personal data, use it for targeted advertising, or use meal content to train an XYK AI model.

6. Acceptable use

You may use GlizzyScan only for lawful, personal purposes. You may not:

• upload content you do not have the right to use, or content that is unlawful, abusive, malicious, or infringes another person’s rights;
• bypass subscription checks, usage limits, authentication, App Check, rate limits, or other security controls;
• reverse engineer, scrape, probe, disrupt, overload, or gain unauthorized access to the service, except where applicable law expressly permits it;
• use automated means to create accounts or send requests, resell the service, or use outputs to develop a competing model or service; or
• misrepresent an estimate as professional medical or dietary advice.

We may investigate misuse and restrict or suspend access when reasonably necessary to protect users, providers, XYK, or the service.

7. Intellectual property

GlizzyScan, its software, branding, design, and original content are owned by XYK or its licensors and are protected by intellectual-property laws. Except for the limited license in the Apple EULA, no rights are transferred to you. Third-party food data, trademarks, and services remain the property of their respective owners.

8. Third-party services and content

GlizzyScan relies on services provided by Apple, Google/Firebase, RevenueCat, OpenAI, and Open Food Facts. Those services may have their own terms and privacy practices. Food-database entries and AI outputs are third-party or automated content and are not guaranteed by XYK. We are not responsible for third-party services to the extent permitted by law, but we remain responsible for our own obligations that cannot lawfully be delegated.

9. Service changes and termination

We may update, add, remove, suspend, or discontinue features, impose reasonable usage limits, or stop offering the service. We will provide notice when required by law. You may stop using GlizzyScan at any time and can delete cloud account data and local diary data from Settings. Pro access remains subject to your Apple subscription until canceled.

We may suspend or terminate access for a material breach of these Terms, fraud, unlawful conduct, security risk, or harm to the service or others. Provisions that by their nature should survive—including ownership, disclaimers, liability limits, and dispute terms—survive termination.

10. Disclaimers

To the fullest extent permitted by law, GlizzyScan and all estimates, data, and services are provided “as is” and “as available.” XYK disclaims implied warranties of merchantability, fitness for a particular purpose, accuracy, non-infringement, and uninterrupted or error-free operation. We do not warrant that calorie or nutrient estimates are correct or suitable for any health objective.

Some jurisdictions do not allow certain warranty exclusions. Nothing in these Terms excludes warranties, guarantees, or consumer rights that cannot lawfully be excluded.

11. Limitation of liability

To the fullest extent permitted by law, XYK and its members, officers, employees, contractors, and licensors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, goodwill, or business interruption, arising from GlizzyScan—even if advised that such damages are possible.

To the fullest extent permitted by law, XYK’s total aggregate liability arising from GlizzyScan will not exceed the greater of (a) US$100 or (b) the amount you paid for GlizzyScan during the 12 months before the event giving rise to the claim. These limits do not apply to liability that cannot lawfully be limited, including liability for fraud, willful misconduct, or personal injury where applicable law prohibits limitation.

12. Indemnity

To the extent permitted by law, you will defend, indemnify, and hold harmless XYK and its personnel from third-party claims, damages, and reasonable costs arising from your unlawful content, material breach of these Terms, or misuse of GlizzyScan. This obligation does not apply to the extent a claim results from XYK’s own negligence, willful misconduct, or violation of law.

13. Disputes and applicable law

Before filing a claim, please email xyklabs@gmail.com with a description of the issue and requested resolution so we can try to resolve it informally. These Terms are governed by the laws that apply to XYK and your use of the service, without depriving you of mandatory consumer protections in your place of residence. Any dispute may be brought in a court with lawful jurisdiction. Nothing here restricts a non-waivable right to contact a regulator, consumer-protection body, or small-claims court.

14. General terms

You may not assign these Terms without our consent; we may assign them as part of a merger, financing, reorganization, sale of assets, or by operation of law. If any provision is unenforceable, it will be limited to the minimum extent necessary and the remaining provisions will remain effective. A failure to enforce a provision is not a waiver. These Terms, the incorporated Apple EULA, and the referenced privacy policies are the entire agreement about GlizzyScan and replace prior related understandings.

15. Apple-specific terms

You and XYK acknowledge that these Terms are between you and XYK, not Apple. XYK, not Apple, is responsible for GlizzyScan and its content, maintenance, support, and any warranties not effectively disclaimed. Apple has no obligation to provide maintenance or support. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce the Apple-related provisions once you accept them. Your use must comply with applicable third-party terms and U.S. export and sanctions laws.

16. Changes and contact

We may update these Terms to reflect product, legal, or security changes. We will post the revised date and provide additional notice when required. Continued use after an update takes effect constitutes acceptance where permitted by law.
