License
Pickems is licensed, not sold, to you by XYK LLC for use on Apple devices you own or control. These terms supplement Apple's Standard Licensed Application End User License Agreement. If these terms conflict with Apple's Standard EULA, the Standard EULA controls. Beta builds distributed through TestFlight are also governed by Apple's TestFlight terms.
Eligibility and acceptance
You must be at least 13 years old and legally able to agree to these terms. If local law requires a higher minimum age or parental permission, that requirement applies. By creating or using an account, you agree to these terms and acknowledge the Privacy Policy. Do not use Pickems if you do not agree.
Free to play — no gambling
Pickems is a free entertainment app. It offers no wagering, accepts no stakes, charges no entry fees, and awards no prizes. Any arrangements league members make among themselves happen outside the app, are not facilitated by it, and are entirely their own responsibility — including compliance with local law.
Leagues and conduct
Leagues are private and invite-only. Commissioners can settle props and correct settlements; corrections are logged for the league. You must not submit content that is unlawful, threatening, harassing, hateful, sexually explicit, deceptive, invasive of privacy, infringing, or designed to exploit or harm another person. You also must not impersonate others, misuse invite codes, interfere with the service, attempt unauthorized access, scrape the service, or evade safety controls.
Pickems filters certain objectionable text. You can report or block another member from their league profile, and commissioners can remove members. Reports may include the relevant league name, reported display name, and props created by the reported member so XYK LLC can investigate. We may review reports, remove or restrict content, disable invite codes, or suspend or terminate accounts to protect users, enforce these terms, or comply with law. Your content
You retain ownership of content you submit. You grant XYK LLC a limited, non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, and process that content only as reasonably necessary to operate, secure, moderate, and improve Pickems and to comply with law. This license ends when the content is deleted, except for de-identified shared league records and safety or legal records retained as described in the Privacy Policy. You represent that you have the rights needed to submit your content and that it does not violate another person's rights.
Service, accounts, and availability
You may use a guest account or sign in with Apple or Google. Guest accounts are tied to the app installation and may not be recoverable after deletion, device erasure, or a device change; provider accounts can restore access on supported devices. You are responsible for access to your Apple or Google account. Keep invite codes within the people you intend to admit to a league. You may permanently delete any account in the app from Profile; completed league records may retain de-identified picks and settlements as described in the Privacy Policy.
Schedules, kickoff times, scores, and status information come from third-party data sources and may be delayed, incomplete, or wrong. We may change, suspend, or discontinue features, and we do not promise uninterrupted availability. Game locks and automated scoring use the information available to the service; commissioners remain responsible for resolving custom props.
Intellectual property and third-party services
Pickems, its software, design, and original content are owned by XYK LLC or its licensors. Football league and team names are the property of their respective owners and identify games; Pickems does not include official team logos. Pickems and XYK LLC are not affiliated with, sponsored by, or endorsed by the NFL, ESPN, or any team.
Apple, Firebase, Google Sign-In, Vercel, and game-data services are operated by third parties under their own terms and policies. Apple is not responsible for Pickems or its support, maintenance, warranties, claims, or content except as stated in Apple's Standard EULA. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce the terms as they relate to the licensed iOS app.
No warranty; limitation of liability
Pickems is provided "as is" and "as available", without warranties of any kind, subject to rights that cannot legally be excluded. To the maximum extent permitted by law, XYK LLC is not liable for indirect, incidental, special, or consequential damages arising from use of the app, reliance on game data, lost access to an account, provider outages, or disputes between league members.
Termination
You may stop using Pickems or delete your account at any time. We may suspend or terminate access for material or repeated violations of these terms, threats to the service or other users, or legal requirements. Sections that by their nature should survive termination — including intellectual property, disclaimers, and limitations of liability — will survive.
Changes
We may update the app and these terms; the effective date above identifies the current version. Continued use after an update is acceptance of the revised terms.
